1. Acceptance of the Terms of Service

These Terms of Service (hereinafter referred to as "Terms") constitute a legally binding agreement between you (hereinafter referred to as "You," "you," or "User") and AeroLeaps (hereinafter referred to as "AeroLeaps," "we," or "us"). These Terms govern your access to and use of the AeroLeaps website (https://aeroleaps.com), any AeroLeaps mobile or desktop applications (the "Apps"), and any content, functionality, technology solutions and services offered on or through the website or Apps, including the free and paid subscription services (collectively, the "Services").

By using the AeroLeaps Services in any way, you accept and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Services.

AeroLeaps reserves the right to change these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last modified" date at the top of this page. It is your responsibility to review these Terms periodically for changes. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

2. Eligibility

The AeroLeaps Services are offered and available to users who are 18 years of age or older. By using the Services, you represent and warrant that you are of legal age to form a binding contract with AeroLeaps and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services.

3. Registration and Account Security

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify AeroLeaps immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Description of Services

AeroLeaps provides a service that alerts users to flight deals based on their preferences and search criteria. We do not sell flights or act as a travel agency. Our service is informational only, and we are not responsible for the accuracy of flight information, pricing, or availability. Users are responsible for verifying all information and making bookings directly with airlines or travel agencies.

5. Subscription and Fees

AeroLeaps offers both free and paid subscription services. By signing up for a paid subscription, you agree to pay the applicable fees as they become due. Fees are non-refundable except as required by Dutch law or as explicitly stated in these Terms.

We reserve the right to change our fees or billing methods at any time. We will provide you with notice of any price change or change to your billing method at least 30 days in advance of the billing period in which it will take effect.

6. Cancellation and Termination

You may cancel your subscription at any time by following the instructions on our website or by contacting our customer support. If you cancel, your subscription will remain active until the end of your current billing period.

AeroLeaps reserves the right to terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

7. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by AeroLeaps, its licensors, or other providers of such material and are protected by Dutch and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

8. User Contributions

The Services may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit to other users or other persons content or materials on or through the Services.

Any User Contribution you post to the Services will be considered non-confidential and non-proprietary. By providing any User Contribution on the Services, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

9. Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate AeroLeaps, an AeroLeaps employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm AeroLeaps or users of the Services or expose them to liability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AEROLEAPS DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL AEROLEAPS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Netherlands. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of the Netherlands.
